Terms of Service

1. Introduction

AI Influencer ("the Service") is owned and operated by Kawaii, Inc. ("we", "us", "our"). The Service lets you create an AI influencer from photos you provide and generate images and videos of that influencer using AI. These Terms of Service ("Terms") are a legal agreement between you and Kawaii, Inc. governing your use of the Service.

2. Acceptance of Terms

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old to use the Service.

4. Accounts

You sign in with a Google account. You are responsible for all activity under your account and for keeping your credentials secure. We may suspend or terminate accounts that violate these Terms.

5. Photos you upload and consent

You may only upload photos that depict either (a) yourself, or (b) an adult who has given you explicit written permission to create AI-generated images and videos of them. Every person depicted must be 18 or older and must not be a politically exposed person or public figure. You must own or hold the rights to every photo you upload. We do not verify identity, consent or rights, and you are solely responsible for any misuse, including violations of privacy, publicity, likeness or intellectual-property rights. Uploaded photos are automatically screened and may be rejected.

6. Acceptable use

You must not use the Service to create, share or display content that:

• is sexual, pornographic or sexually suggestive, or depicts nudity;
• depicts or appears to depict a minor in any context;
• impersonates a real person without their consent, or is intended to deceive, defraud, defame or harass;
• is illegal, hateful, violent, or promotes self-harm;
• infringes any copyright, trademark, privacy or publicity right; or
• attempts to bypass our safety filters.

Prompts and outputs are automatically moderated. We may remove content and terminate accounts, at our discretion, for violations.

7. Ownership of outputs

Subject to these Terms and applicable law, you own any output produced by the Service at your direction, including without limitation images, videos, text and other content. Because the copyright treatment of AI-generated content varies by jurisdiction, we cannot guarantee that outputs are protectable and we do not provide legal advice.

7a. License grant to AI Influencer

By using the Service, you grant to AI Influencer, Kawaii, Inc., its successors and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense and/or distribute any content you submit, create or make available through the Service, including without limitation the text prompts, scene descriptions, motion directions and edit instructions you enter; the images, videos and any other output produced by the Service at your direction; the influencers you create, including their names, descriptions and the selection and arrangement of the creations associated with them; and your profile information, including your username, display name and profile picture. This section does not give us any right to publish or distribute the reference photos you upload as inputs beyond the storage and processing described in section 5 and in our Privacy Policy. Deleting a creation or an influencer does not revoke or limit the license granted under this section with respect to content already created. The license granted to AI Influencer remains in effect after termination of this Agreement by any party, for any reason.

8. Credits, subscriptions and payments

Generations consume credits. New accounts receive a small number of free credits. Credits can be purchased as one-time packs, which do not expire, or through a monthly subscription that grants a credit allowance at the start of each billing period. Subscription credits reset at each renewal and do not roll over; subscription credits are used before pack credits. Subscriptions renew automatically until cancelled from the billing portal; cancellation takes effect at the end of the current period. Upgrades take effect immediately and are charged the price difference; downgrades take effect at the next renewal. Payments are processed by Stripe. Prices exclude applicable taxes.

Credits are not money, have no cash value, and are non-transferable. Because outputs are generated on demand at real cost to us, purchases are non-refundable except where required by law. Credits for a generation are refunded only when the request is stopped before it is sent to the AI model (for example a blocked prompt or a rejected upload). Once a request has been sent, credits are not refunded, including when the model fails, times out or rejects the request, or when you are unhappy with the output.

9. Third-party AI providers

Your prompts, photos and generated content are processed by third-party AI platforms, currently OpenAI (images, edits and moderation), fal (video), Replicate (upscaling) and OpenRouter (prompt planning). Their processing is described in our Privacy Policy.

10. Availability and changes

The Service is provided "as is". We may change, suspend or discontinue features, models, prices or credit costs at any time. We will post material changes to these Terms on the Service; continued use after changes means you accept them.

11. Disclaimer and limitation of liability

To the fullest extent permitted by law, Kawaii, Inc. disclaims all warranties, express or implied, and will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

12. Indemnity

You will indemnify and hold harmless Kawaii, Inc. from any claim arising from photos you upload, content you generate, or your breach of these Terms, including claims by people depicted in your photos.

13. Termination

We may suspend or terminate your access at any time for breach of these Terms. You may delete your influencers and creations at any time from the Service.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Kawaii, Inc. is based, without regard to conflict-of-law rules.
